2. Service Description

TextFit is an AI-powered SMS fitness coaching service that provides:

• Personalized daily workout plans delivered via text message
• Nutrition tracking, including AI-powered analysis of food photos to estimate calories and macronutrients
• Progress updates and accountability check-ins

Messages are sent on weekdays, typically 1 to 3 messages per day. Frequency may vary based on your interactions and preferences.

3. Opt-In and Consent

You opt in by texting our phone number. By sending your first message, you consent to receive recurring SMS messages from TextFit. Message and data rates may apply depending on your mobile carrier and plan.

4. Opt-Out

You can opt out at any time by replying STOP to any message. You will receive a confirmation and no further texts will be sent. For help, reply HELP.

5. Eligibility

You must be at least 18 years old to use TextFit. By using the Service, you represent that you are at least 18 years of age.

6. Not Medical Advice

TextFit is not a medical service and does not provide medical advice. The workout plans, nutritional estimates, and coaching provided are generated by AI and are for informational and general fitness purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

You should consult a qualified healthcare provider before starting any new exercise or nutrition program, especially if you have pre-existing medical conditions, injuries, or health concerns. You assume all risk associated with following any guidance from TextFit.

7. AI-Generated Content

TextFit uses AI technology (Claude by Anthropic) to generate responses, workout plans, and nutritional estimates. AI-generated content may contain errors or inaccuracies. Calorie and macronutrient estimates from food photo analysis are approximations. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content.

8. User Responsibilities

• Provide accurate information about yourself, including your fitness level and relevant health conditions
• Listen to your body and stop any exercise that causes pain or discomfort
• Not rely on TextFit as a substitute for professional medical or nutritional advice
• Use the Service only for lawful purposes

9. Privacy

Your use of TextFit is also governed by our Privacy Policy.

10. Limitation of Liability

To the fullest extent permitted by law, Makers Technology LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of TextFit. This includes, without limitation, damages for personal injury, lost profits, or data loss. Our total liability for any claim shall not exceed $50 or the amount you have paid us in the 12 months preceding the claim, whichever is greater.

11. Disclaimer of Warranties

TextFit is provided “as is” and “as available” without warranties of any kind, whether express or implied. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify and hold harmless Makers Technology LLC from any claims, damages, losses, or expenses arising from your use of the Service or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of North Carolina. Any disputes shall be resolved in the state or federal courts located in Wake County, North Carolina.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via SMS before the changes take effect.
